  4. License for Individual Use

  6. This software is licensed to you for your own individual use.  You
  7. may copy this software for archive purposes, to protect your
  8. investment.  This software is protected by U.S. and international
  9. copyright law and cannot be copied or otherwise made available to
  10. more than one person at the same time, without violating the law.
  11. Starfish reserves all rights not specifically granted.

  15. To allow more than one person to use this software, you or your
  16. company or organization can purchase additional software for each
  17. person.

  19. Upgrades

  21. If this software is an upgrade version of software that you
  22. previously acquired, you have not acquired two different rights to
  23. use this software and its earlier version. This upgrade and the
  24. earlier version together constitute just one copy of the software and
  25. may be used only by you.

  27. Other Limits on Your Use

  29. Except as described in this license, without the written consent of
  30. Starfish Software, you may not transfer, rent, lease, lend, copy,
  31. modify, translate, sublicense, time-share, electronically transmit or
  32. receive, or decompile or reverse engineer this software or the media
  33. and documentation.

  36. Limited Warranty

  38. This product comes with "Philippe's Guarantee," which entitles you to
  39. a refund of the amount you actually paid, if any, within 30 days of
  40. your purchase. Contact Starfish for details.

  42. Also, the physical media for this product provided by Starfish (if
  43. any) are guaranteed to be free of defects in materials and
  44. workmanship for 120 days from the date this product was originally
  45. purchased. If a defect occurs within this 120-day period, simply
  46. return the defective media to Starfish along with a dated proof of
  47. purchase, and Starfish will replace it free of charge. Starfish makes
  48. no representation or warranty regarding the content of this product,
  49. including its software and documentation. For example,
  50. Starfish does not warrant that the software or documentation are
  51. "error-free" or will meet the needs and requirements of a particular
  52. user. All information in the software and documentation is subject to
  53. change without notice. In addition, Starfish makes no representation
  54. or warranty regarding products, media, software or documentation
  55. manufactured or supplied by others.

  57. ALL OTHER WARRANTIES, REPRESENTATIONS, CONDITIONS, EXPRESS OR
  58. IMPLIED, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF

  65. The only remedy under this limited warranty or Philippe's Guarantee
  66. is replacement of the defective media or refund of the actual amount
  67. paid. Starfish disclaims any liability for damages arising from the
  68. use of this product or any other damages, including (though not
  69. limited to) lost profits or data, special, incidental, or other
  70. claims, even if Starfish has been specifically advised of the
  71. possibility of such claims. Regardless of the form of the claim, the
  72. only liability Starfish will have to you or any other person will be
  73. limited to the amount actually paid for the product.

  77. This license and limited warranty can only be modified in writing
  78. signed by you and an authorized officer of Starfish. If any part or
  79. provision is found to be unenforceable or void, the remainder shall
  80. be valid and enforceable. If any remedy provided is determined to
  81. have failed of its essential purpose, all limitations of liability
  82. and exclusions of damages shall remain in effect.

  84. Use, duplication or disclosure of this software and documentation by
  85. the U.S. Government is subject to the restricted rights applicable to
  86. commercial computer software (under FAR 52.227-19 and DFARS
  87. 252.227-7013). Sale of this software is subject to the U.S. Commerce
  88. Department export restrictions. This software is intended for use in
  89. the country in which Starfish sold it (or the EEC if first sold in
  90. the EEC).

  93. of California, U.S.A.  You have specific legal rights under this
  94. document, and may have other rights that vary from state to state and
